1. Introduction

Welcome to 1ClickTickets. These Terms and Conditions (“Terms”) govern your access to and use of our event ticketing platform, including our website, mobile applications, and related services (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Platform.

1ClickTickets is operated by Arcane Arts, a limited liability company (SRL) registered in Romania under registration number 12345678, CUI CUI (“we,” “us,” or “our”).

2. Definitions

“User” – any person who accesses or uses the Platform.

“Organizer” – any person or entity that creates and manages events on the Platform.

“Attendee” – any person who purchases or registers for event tickets through the Platform.

“Event” – any occasion, activity, or gathering listed on the Platform.

“Ticket” – a digital or physical pass that grants entry to an Event.

3. User Accounts

3.1 Account Creation: To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Age Requirement: You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you are at least 18 years of age.

3.4 Account Termination: We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in fraudulent, illegal, or abusive behavior.

4. Ticket Purchases

4.1 Ticket Availability: Tickets are subject to availability and may be limited. We do not guarantee that tickets will be available for any particular Event.

4.2 Pricing: All ticket prices are displayed in the currency specified at the time of purchase and include applicable taxes and service fees unless otherwise stated.

4.3 Payment: Payment must be made in full at the time of purchase using one of our accepted payment methods. We use secure third-party payment processors to handle transactions.

4.4 Order Confirmation: Upon successful purchase, you will receive an order confirmation via email containing your ticket details and a unique order reference number.

4.5 Ticket Delivery: E-tickets will be delivered to the email address provided during purchase. You are responsible for ensuring the accuracy of your email address.

4.6 Ticket Transfer: Unless prohibited by the Organizer, you may transfer your ticket to another person. The transferee will be subject to these Terms.

5. Refunds and Cancellations

5.1 Refund Policy: Refunds are subject to the Organizer's refund policy for each specific Event. Please review our Refunds Policy for detailed information.

5.2 Event Cancellation: If an Event is cancelled by the Organizer, you will be notified and entitled to a full refund of the ticket price, excluding service fees (unless required by law).

5.3 Event Postponement: If an Event is postponed, your ticket will remain valid for the rescheduled date. If you cannot attend the rescheduled Event, you may request a refund in accordance with the Organizer's policy.

5.4 Refund Processing: Approved refunds will be processed within 7-14 business days to the original payment method.

6. Data Protection and Privacy (GDPR)

6.1 Data Controller: 1ClickTickets acts as a data controller for personal data we collect directly from you. Event Organizers act as data controllers for data collected in connection with their Events.

6.2 Your Rights: Under the General Data Protection Regulation (GDPR), you have the following rights:

Right to Access – request copies of your personal data
Right to Rectification – request correction of inaccurate data
Right to Erasure – request deletion of your personal data
Right to Restrict Processing – request limitation of data processing
Right to Data Portability – receive your data in a structured, machine-readable format
Right to Object – object to certain types of processing
Right to Withdraw Consent – withdraw consent for data processing at any time

6.3 Legal Basis: We process your personal data based on:

Performance of contract (ticket purchases, account management)
Legitimate interests (fraud prevention, platform security)
Legal obligations (tax, accounting requirements)
Your consent (marketing communications)

6.4 Data Retention: We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, or as required by law (typically 7 years for financial records).

6.5 International Transfers: Your data may be transferred to and processed in countries outside the European Economic Area (EEA). We ensure appropriate safeguards are in place for such transfers.

7. User Conduct

You agree not to:

Use the Platform for any illegal purpose or in violation of any local, national, or international law
Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
Engage in fraudulent activities, including purchasing tickets with stolen payment methods
Resell tickets at prices exceeding face value where prohibited by law
Use automated systems (bots) to purchase tickets in bulk
Interfere with or disrupt the Platform's security, integrity, or performance
Attempt to gain unauthorized access to other users' accounts or data
Upload or transmit viruses, malware, or other harmful code
Harass, abuse, or harm other users or Organizers

8. Organizer Responsibilities

Event Organizers agree to:

Provide accurate and complete information about their Events
Comply with all applicable laws and regulations regarding their Events
Honor all ticket sales and provide the Event as described
Maintain appropriate insurance and licenses for their Events
Process refunds in accordance with their stated refund policy and applicable law
Not discriminate against Attendees on the basis of protected characteristics
Comply with GDPR and data protection laws when collecting Attendee data

9. Intellectual Property

9.1 Platform Content: All content on the Platform, including text, graphics, logos, images, software, and design, is the property of 1ClickTickets or its licensors and is protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.

9.3 User Content: By uploading content to the Platform, you grant us a worldwide, royalty-free license to use, reproduce, and display that content for the purpose of providing our services.

10. Limitation of Liability

10.1 Platform Availability: We strive to keep the Platform accessible 24/7, but we do not guarantee uninterrupted or error-free service. The Platform is provided “as is” and “as available” without warranties of any kind.

10.2 Event Responsibility: We are not responsible for the quality, safety, legality, or any other aspect of Events listed on the Platform. Organizers are solely responsible for their Events.

10.3 Limitation of Damages: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

10.4 Maximum Liability: Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless 1ClickTickets, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

Your violation of these Terms
Your use of the Platform
Your violation of any rights of another party
Your violation of any applicable laws or regulations

12. Dispute Resolution

12.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

12.2 Jurisdiction: Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Magheru 9A, Romania.

12.3 EU Online Dispute Resolution: If you are a consumer based in the European Union, you may also access the European Commission's Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on the Platform or sending you an email. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

The “Last Updated” date at the top of this page indicates when these Terms were last revised.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
